General Description: This tract of land has 64 acres of cultivation with the balance being pasture. This property currently has approx.17 acres of Alfalfa, 5 acres of established Brome grass and 42 acres of Milo.  2005 Taxes - $539.50

MINERAL RESERVATION: excepting and reserving unto said grantor(s), its successors, and assigns all the interest in and to the oil and gas and other minerals in and under and that may be produced from the afore-described real estate together with the right of ingress and egress for the purpose of drilling, mining and exploring said land for oil, gas and other minerals reserved and excepted here from.

Terms: 20% down day of sale with the balance to be paid at closing.

Possession:            Buyer shall be given possession of all pasture and unplanted acres on March 1, 2007 and possession any acres planted to wheat shall be immediate following the 2007 wheat harvest.

Growing Crops:  Buyers shall receive and undivided 1/3rd of the 2006 Milo crop and of the 2007 wheat crop.

Title Insurance:            Title insurance shall be used to prove clear & merchantable title with the Buyer & Seller sharing equally the owner’s policy expense. The mortgage  policy, if required, will be the expense of the buyer.

Taxes & FSA Pmts. The 2005 and prior years taxes will be paid in full by the sellers. 2006 Taxes will be prorated to date of closing. All subsequent years taxes will be the responsibility of the buyer. Seller shall convey to buyer all land owners share of the FSA payments that may be payable from the date of this sale.
