LAND AUCTION

Selling 480 Acres ± of Rooks County Kansas Pasture Land

Thursday, November 4th, 2010 10:00 A.M.

Auction Location: 109 N. Elm (Legion Hall) Stockton, Ks.

Land Location: Approx. 7 mi. Southeast of Stockton, Ks. – Intersection of L & 24 Rd will be the Northwest Corner of subject property Look for Signs!

Legal Description: The North Half (N/2) and the Southeast Quarter (SE/4) of Section Thirty Six (36), Township Seven (7) South, Range Seventeen (17) West of the 6th P.M., Rooks County, Kansas being 480 acres more or less.

General Description: This is an excellent tract of pasture land and expired CRP grass has abundant spring fed dug pits and good fences and a good variety native and planted grasses. The expired CRP will provide excellent grazing as well as good haying potential. This property provides lots of habitat for wild game such as deer and turkey and possibly many other species.

Terms: 10% down day of sale with the balance to be paid at closing.

Possession: Buyer shall be given possession immediate upon closing

Minerals: Seller shall convey all mineral rights on the Northwest Quarter (NW/4) and the West Half of the Northeast Quarter (W/2NE/4) in 36-7-17. The minerals on the East Half of the Northeast Quarter (E/2NE/4) and the Southeast Quarter (SE/4) in 36-7-17 are subject to a previous reservation and shall revert back to the surface owner on Dec. 2, 2016 if not developed.

Title Insurance: Title insurance shall be used to prove clear & merchantable title with the Buyer & Seller sharing equally the owner’s policy expense. The mortgage policy, if required, will be the expense of the buyer.

Taxes: Seller shall pay all 2010 and prior years taxes. All subsequent years taxes will be the responsibility of the buyer. 2009 Taxes were $531.60

Conditions: All acreages are considered to be approximate and are deemed to be from reliable county & FSA sources. Buyers are encouraged to verify details and view properties prior to the auction. Announcements made day of sale shall take precedence over printed material. This auction sale is not contingent upon the purchaser's ability to finance the purchase.
